Mailpool Terms & Conditions

1. Introduction

These Terms & Conditions (“Terms”) constitute a legally binding agreement between you (“User,” “Customer,” or “You”) and Mailpool (“We,” “Us,” or “Mailpool”) governing the use of Mailpool's services, website, and infrastructure. Mailpool provides advanced inbox and domain creation solutions, including email account provisioning, domain registration, and integration with third-party email service providers (“Third-Party Providers”). By accessing and using Mailpool’s services, you acknowledge that you have read, understood, and agreed to abide by these Terms. If you do not agree with any part of these Terms, you must immediately cease using Mailpool’s services.

Mailpool offers its services under specific conditions, which include but are not limited to shared inboxes, Google Workspace inboxes, Microsoft 365 inboxes (Beta), and dedicated servers. The User acknowledges that these services may be subject to restrictions imposed by third-party providers, and Mailpool shall not be liable for any limitations, suspensions, or changes enforced by these external entities.

2. Definitions
  • Mailpool Services refer to the infrastructure and technologies provided by Mailpool, which include inbox and domain creation, email hosting, and integrations with external providers.
  • User refers to any individual, business, organization, or entity utilizing Mailpool’s services.
  • Third-Party Providers are external entities, such as Google Workspace and Microsoft 365, that facilitate the provision of Mailpool’s services.
  • ESP Terms of Service are the policies established by third-party providers governing their email infrastructure.
  • Misuse refers to the unauthorized or prohibited use of Mailpool’s services, including spam, phishing, and fraud.
  • Force Majeure Event includes any unforeseen circumstances beyond Mailpool’s control that affect service availability.
3. Description of Services & Limitations

Mailpool provides scalable inbox and domain creation services, supporting a variety of configurations to suit different User needs. The services include:

  • Shared Inboxes, available on request through Mailpool’s infrastructure or third-party providers, with a sending limit of 200 emails per day per inbox.
  • Google Workspace Inboxes, allowing professional business email access, with a sending limit of 2,000 emails per month per inbox.
  • Microsoft 365 Inboxes (Beta), offered as an enterprise-grade email solution with restricted availability due to its beta status.
  • Dedicated Server Solutions, which provide Users with private email infrastructure, allowing for customized configurations and scalable sending limits.

Mailpool does not guarantee specific email deliverability rates, as performance is subject to factors such as sender reputation, third-party policies, and recipient filtering mechanisms. Additionally, Mailpool is not responsible for price increases imposed by ESPs, including Google Workspace and Microsoft 365. The pricing of Mailpool’s services is subject to revision in response to third-party cost adjustments or operational requirements.

4. Acceptance of Terms

By using Mailpool’s services, you confirm that you have read and agreed to these Terms. Users acknowledge that they must comply with all relevant laws, regulations, and ESP Terms of Service. Any User found violating these Terms may face account suspension or termination without prior notice.

5. Account Registration & Responsibilities

To access Mailpool’s services, Users must register an account and provide accurate information. Users are responsible for safeguarding their credentials and ensuring compliance with all applicable regulations. Any fraudulent or deceptive account activity will result in immediate account suspension.Mailpool retains the right to conduct compliance audits and to terminate accounts engaged in violations of these Terms. Suspended accounts are not eligible for refunds.

6. Misuse Policy & Restrictions

Users must refrain from using Mailpool’s services for any activities that violate laws, ethical standards, or third-party policies. Prohibited activities include, but are not limited to:

  • Spamming, phishing, and the unauthorized collection of data.
  • Distributing malware, automated bots, or fraudulent content.
  • Attempting to bypass email security mechanisms imposed by ESPs.

Mailpool reserves the right to block, restrict, or delete any inboxes or domains involved in misuse, and to report violations to regulatory authorities.

7. Third-Party Providers & Liability Disclaimer

Mailpool relies on third-party providers, including Google Workspace and Microsoft 365, to deliver certain services. Users acknowledge that these providers may impose their own limitations, restrictions, or suspensions at their discretion.Mailpool is not responsible for service interruptions, inbox suspensions, or policy changes implemented by third-party providers. Users understand that these providers may modify their terms at any time, and Mailpool cannot intervene in such modifications.

8. Fees & Payment Terms

Mailpool’s services operate on a subscription-based billing model.

  • Refunds are not issued, except in cases required by law.

Failure to complete payment may result in service suspension or termination.

9. Intellectual Property

Mailpool maintains full ownership of its proprietary software, UI, branding, and technology. Users are strictly prohibited from reverse-engineering, modifying, or distributing any Mailpool technology.Unauthorized use of Mailpool’s intellectual property will result in legal action and damages up to $5,000,000 per breach.

10. Confidentiality

Users must not disclose proprietary information regarding Mailpool’s technology, infrastructure, or operational methodologies. Any breach of confidentiality will result in legal consequences, including termination of service.

11. Limitation of Liability

Mailpool’s total aggregate liability is limited to the fees paid by the User in the last one (1) month.Mailpool is not liable for:

  • Indirect or incidental damages.
  • Business losses resulting from service disruptions.
  • Inbox suspensions enforced by third-party providers.

Users acknowledge that the use of Mailpool’s services entails inherent risks, including ESP policy changes.

12. Indemnification

Users agree to indemnify and hold Mailpool harmless from any claims, disputes, or financial losses arising from:

  • Violations of these Terms.
  • ESP-imposed penalties due to User activity.
  • Unauthorized use of Mailpool’s services.

13. Termination & Suspension

Mailpool reserves the right to suspend or terminate any account without prior notice if a User violates these Terms. Upon termination, Users must:

  • Cease using Mailpool services.
  • Delete any confidential data obtained through Mailpool.

Users who cancel their subscriptions will not receive refunds.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of Brussels, Belgium. Any legal disputes will first be addressed through negotiation. If a resolution is not achieved, the matter will be submitted to arbitration in Brussels, Belgium.

15. Modifications to Terms
